
Can a landlord forbid pets in your rental home?
You've found your dream home. The location is perfect, the rent is (just about) affordable. You're about to sign, but then you see Article 14: "Keeping pets is strictly prohibited." You look at your loyal Golden Retriever Max. Do you now have to choose between your dog and a roof over your head? Not so fast. In most cases, such a ban is completely worthless.
Dutch judges are quite animal-friendly. Or actually: human-friendly. Because the right to a pet falls under your "right to private life". But how exactly does that work? And can you just sign that contract with that forbidden clause and take Max with you anyway? (Spoiler: Often yes, but be careful.)
1. The Law vs. The Contract
Many standard rental contracts (the ROZ model) state by default that pets are not allowed, or only with permission. Landlords like that: no hair, no smell, no scratches.
⚖️ What does the judge say?
According to case law, a total ban on pets is an unreasonable infringement of your personal privacy (Article 8 ECHR). A landlord cannot determine who (or what) you bring into your home, as long as you do not cause a nuisance. Such a provision in the contract is therefore often voidable.
2. When CAN it be prohibited?
It is not a free pass to start a zoo. The judge always balances the interests.
- Unsuitable property: Three Great Danes in a 20m² studio? That is pitiful and causes nuisance. The judge will agree with the landlord.
- Nuisance: A dog that barks 8 hours a day, a cat that pees in the hallway, or a snake that escapes. In case of structural nuisance, the judge can pronounce dissolution of the rental contract.
- Allergy/Health: Do you rent a room in the landlord's house (lodger) and is she severely allergic? Then her health comes first.
- HOA Rules: Sometimes the Homeowners Association prohibits pets in the entire building. This is harder to challenge.
3. Do you have to ask for permission in advance?
This is the dilemma.
- The Honest Route: You ask in advance. Risk: The landlord simply chooses another tenant who has NO pet. Honesty lasts the longest, but you will be on the street.
- The "Don't Ask Don't Tell" Route: You sign the contract (even with a ban), and just take your dog with you. Legally you are quite strong if the landlord finds out later and goes to court. The judge will almost never allow dissolution of the contract for one well-behaved dog or cat, even if the contract forbids it.
4. Assistance dogs are sacred
Do you have an accredited assistance dog (guide dog, service dog)? Then the landlord has absolutely NOTHING to say.
🦮 Legal Right:
Refusing an assistance dog is discrimination based on disability (Equal Treatment Act). This is strictly forbidden. Also in a "pet-free" apartment complex.
5. Tips for tenants with pets
- Provide a "Pet Resume": Add a photo of your pet to your registration, with info. "Max is 8 years old, neutered, never barks and has done a dog course." This removes fear from landlords.
- Offer an extra deposit: Propose to pay 1 month extra deposit or include a special cleaning clause. This covers the risk for the landlord.
- Do not cause nuisance: This is your most important duty. Ensure that neighbors are not bothered, then the landlord has no leg to stand on.
Is there more nonsense in your contract?
